Acting for the beneficiaries of a Jersey law trust in the first Hastings-Bass application after the Supreme Court judgement in Futter-v-Futter / Pitt-v-Holt. The applicants successfully applied the Supreme Court test and the appointment of assets was set aside. The Royal Court also made some important observations about the need for and form of the tax advice which ought to be taken by trustees when making appointments of this sort.
